EstateQuoter is owned and operated by Surplus Haven LLC (“EstateQuoter,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of estatequoter.com (the “Site”) and the quote request services we provide (the “Service”). By using the Site or submitting a quote request, you agree to these Terms.

1. What we do (and what we don’t)

EstateQuoter is an intake and lead-matching service. We help connect people who need estate liquidation, estate sale, or cleanout services (“Users”) with independent estate professionals, such as estate sale companies, liquidators, and cleanout providers (“Estate Professionals”).

Important points:

• We are not an estate liquidator, moving company, or cleanout crew.
• We do not run your sale or perform on-site services.
• We do not control, supervise, or guarantee the work of any Estate Professional.
• Any agreement for services is directly between you and the Estate Professional, not with us.

2. Eligibility

You may use the Site and Service only if you are at least 18 years old and have the authority to enter into these Terms. By using the Site, you represent that you meet these requirements.

3. Your responsibilities

When you use the Site or submit a quote request, you agree to:

• Provide accurate and honest information about the property and your needs.
• Not submit content that is unlawful, harmful, defamatory, or infringes on others’ rights.
• Not attempt to disrupt or harm the Site, Service, or other users.
• Communicate directly and in good faith with Estate Professionals if you choose to engage with them.

4. Quotes and relationships with Estate Professionals

We may share your quote request and related information with one or more Estate Professionals in your area. Those professionals may contact you directly with questions, estimates, or service proposals.

We do not:

• Set prices, fees, or contract terms for Estate Professionals.
• Guarantee that you will receive a certain number of quotes or responses.
• Guarantee the quality, safety, legality, or availability of any services offered by Estate Professionals.

You are responsible for deciding whether to work with any Estate Professional, reviewing their contracts, and performing any checks (such as licenses, insurance, or references) you consider appropriate.

5. User content

“User Content” means any information or materials you submit through the Site, including property details, notes, and optional video walk-throughs.

• You retain any rights you have in your User Content.
• You grant us a non-exclusive, worldwide, royalty-free license to use, store, and share your User Content as needed to operate the Service (for example, sharing with Estate Professionals to generate quotes).
• You represent that you have the right to provide the User Content and to grant this license.

6. Prohibited uses

You agree not to use the Site or Service to:

• Violate any applicable law or regulation.
• Send spam, solicitations, or misleading information.
• Scrape, harvest, or attempt to collect information about other users without permission.
• Reverse engineer, probe, or test the vulnerability of the Site or our systems.
• Interfere with or disrupt the Site or Service.

7. Intellectual property

The Site, including text, design, logos, and other content (excluding User Content and third-party content), is owned by Surplus Haven LLC and protected by intellectual property laws. You may use the Site only for personal, non-commercial purposes in connection with requesting quotes or learning about our Service. You may not copy, modify, or distribute the Site or its content without our permission.

8. Disclaimer of warranties

The Site and Service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the above, we do not warrant that the Site will be uninterrupted or error-free, that any quotes or responses you receive will meet your expectations, or that any Estate Professional will perform services to your satisfaction.

9. Limitation of liability

To the fullest extent permitted by law, Surplus Haven LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Site or Service will not exceed one hundred U.S. dollars (US $100).

10. Indemnification

You agree to indemnify and hold harmless Surplus Haven LLC and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site or Service.
• Your User Content.
• Your interactions or agreements with any Estate Professional.
• Your violation of these Terms or any applicable law.

11. Changes to the Site or Service

We may update, modify, suspend, or discontinue any part of the Site or Service at any time, with or without notice. We are not liable to you or any third party for any such changes.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If we make material changes, we may also provide additional notice on the Site. Your continued use of the Site or Service after any changes means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site or Service will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.
